SF Agrees To Pay $21 Million To Family Of Crash Victim

The city has agreed to pay $21 million to the victims of a 2003 truck crash that killed a 4-year-old girl.

Elizabeth Dominguez died of head injuries after a man driving a city vehicle lost control and pinned the girl against the wall of a pizza restaurant.

"I am glad that the jury was able to see the truth. We miss Elizabeth every day and we always will. We have been through a lot and hope now that healing can begin," said Elizabeth Dominguez' father, Humberto Dominguez.

Dominguez, her mother and friends were walking home from preschool when the Municipal Railway maintenance truck jumped a curb after running a red light.

Sebastian Garcia, the driver, pleaded guilty to misdemeanor manslaughter and is still driving for the city.

A jury awarded the victims $27 million in 2005 and that was later reduced by the trial judge.

The city appealed the judgment and reached the settlement while the appeal was pending.

"This was a horrible human tragedy, and the family of Elizabeth Dominguez has suffered an incalculable loss," said San Francisco city attorney's office spokeswoman Alexis Thompson. "Our hearts continue to go out to them."
