Good Samaritan Killed In Marsh Road Accident

A Good Samaritan, who got out of his car to aid an accident victim on busy Marsh Creek Road in Contra Costa County early Wednesday, was struck and killed by another vehicle, according to the California Highway Patrol.

CHP Sgt. Trent Cross said the single vehicle crash involving a Ford SUV was reported at about 4:42 a.m. on Marsh Creek Road just east of Deer Valley Road,

“The driver of the Ford (involved in the crash) was standing next to his vehicle because he did not suffer any injuries,” Cross sad. “There was a Good Samaritan who stopped to see if he was okay… And shortly thereafter was struck by a passing vehicle. Unfortunately, the Good Samaritan died of his injuries.”

The collision marked the second fatal crash within a week in the same construction zone along a two-mile stretch of Marsh Creek Road, according to California Highway Patrol Officer Scott Yox.

Daniel Lew, a 34-year-old Stockton resident, was traveling west on Marsh Creek Road when he entered a construction zone where contractors are resurfacing the roadway. The posted speed limit through the area is 25 mph, but Lew reportedly failed to slow down, Yox said.

His tires skidded out on some loose gravel as he went around a turn and he lost control of his vehicle, a silver Ford Escape.

The skid caused the sport utility vehicle to flip over and then crash into a tree, Yox said.

Lew was not uninjured in the crash and was able to get out of his vehicle.

He was standing off the roadway when a man later identified by the Contra Costa County coroner's office as 56-year-old Clayton resident William Tindall Jr. came along and saw the crash.

Tindall stopped to help Lew and the two men were standing off the roadway talking when a third vehicle came along.

Lew told officers that he heard the vehicle coming around the corner and heard its tires skid out on the loose gravel. He said he jumped out of the way and when he looked back he couldn't see Tindall.

Yox said Tindall had been struck by a vehicle driven by Gregory Hoedt, a 24-year-old Tracy resident.

Hoedt remained at the scene to give a statement to CHP officers.

"In our minds, both collisions were caused by both drivers going much too fast for the conditions," Yox said.

The first fatal crash on that stretch of roadway occurred Friday shortly before 8 a.m. as Kathleen West, a 33-year-old Oakley mother of two, entered the 25 mph construction zone and also failed to slow down.

She too hit some loose gravel, skidded out and failed to negotiate a turn. Her car went off the roadway and hit a tree. She was pronounced dead at the scene, Yox said.

While Yox said officials couldn't take responsibility for motorists who decide to speed through a construction zone, CHP officers were planning to meet this afternoon with the Contra Costa County Public Works Department and the contractor working on the roadway to see if there was anything they could do to make the road safer.

"These aren't just statistics," Yox said. "These are people who lost their lives, people with families."
