Preliminary Hearing Set For Sep. 9

Attorneys in the Scott Peterson case will be in court Tuesday in Modesto for a discovery hearing. In the discovery hearing, the prosecution has a responsibility to turn over the investigation files to the defendant. The files may include police reports, expert witness opinions and witness statements.

Peterson's upcoming preliminary hearing in Modesto will not only be making headlines, it will be altering traffic patterns in the otherwise quiet rural town.

Peterson is accused of killing his wife, Laci Peterson, and their unborn son in the couple's Modesto home in December. The bodies of Laci Peterson and her baby washed up on the shores of Richmond in April.

Peterson's preliminary hearing is scheduled for Sep. 9 at the Stanislaus County Courthouse in Modesto. The Modesto Police Department has said it will shut down 11th Street in front of the courthouse, and the street will be divided into 32 taped-off spaces. Each space will reportedly be 12 feet by 12 feet in dimension, large enough to accommodate media "pop-up" tents

Maps of the taped-off area will be faxed to media outlets. The Modesto Police said 13 of the spaces have already been reserved by media outlets, and 19 slots remain. If more than 19 media outlets try to get the remaining spaces, police will use a lottery system to decide who gets the spots.
