Man Accused Of Pimping Mentally Challenged Woman In Court

A hearing on a motion filed by the attorney for a man accused of stealing a car in order to chauffeur a mentally challenged woman being used as a prostitute was postponed in San Mateo County court.

Matthew Thrasher, 30, is charged with pimping, infliction of corporal injury upon a cohabitant, vehicle theft, forgery, counterfeiting and identity theft, according to the San Mateo County district attorney's office.

On Thursday, Thrasher's attorney Jeff Boyarsky asked Judge Carl Holm to postpone the hearing until a later date. Boyarsky has filed a motion to enforce a plea bargain that prosecutors previously offered to Thrasher.

San Mateo County Chief Deputy District Attorney Steve Wagstaffe said today that he has never heard of a defense attorney filing such a motion.

"There is just no such thing," Wagstaffe said.

He said prosecutors have the right to revoke a plea bargain at any time prior to the entry of the defendant's plea. He said a judge has the right to revoke a plea bargain at any time.

According to Boyarsky, the plea bargain Thrasher was offered is similar to the one his co-defendant, 35-year-old Jose Orbeta, accepted.

On April 14, Orbeta pleaded no contest to vehicle theft and was sentenced to one year in jail and three years supervised probation, according to the district attorney's office.

Thrasher and Orbeta were arrested on Feb. 16 after San Carlos police, using an OnStar global positioning system, traced a stolen rental car back to a hotel, the district attorney's office reported.

Police tied the stolen car to a room at the hotel, where they reported finding Thrasher, Orbeta and a mentally challenged woman they were allegedly using as a prostitute. Thrasher allegedly used the stolen car to drive the woman to would-be johns, the district attorney's office reported.

Police also located forged and stolen checks, counterfeit check plates and check-making materials inside the hotel room, according to prosecutors.

Thrasher, who remains in custody in lieu of $100,000 bail, will appear in court on June 23 at 9 a.m. for his hearing on the motion to enforce a plea bargain.
