Buried alive; CalOSHA, police investigate fatal construction accident

MILPITAS, Calif. —

A carpenter died at a Milpitas home site after being crashed under an avalanche of dirt caused by a cave-in days after officials had ordered the work to be halted because of safety concerns, authorities said.

Authorities identified the dead worker on Tuesday as Raul Zapata, 39, of Hayward.

Keyvan Irannejad, chief building official with the Milpitas Building and Safety Department, said an inspector with his office had ordered work to be halted at the site located at 814 Calaveras Ridge Drive in the gated Calaveras Ridge Estates neighborhood on Jan. 25th.

Three days later, Irannejad said, authorities responded to the site after receiving a call that worker had been crushed when the walls of a 10- to 12-foot deep trench collapsed.

Zapata's body was finally dug out and removed from the site on Monday night.

City officials had issued the order because of recent rains and an absence of shoring in the foundation had made the site of a 5,800 square foot home unsafe. However, the contractor -- Fremont-based U.S.-Sino Investment -- apparently did not comply with the order.

Police have taped off the area of the accident as a crime scene and state and local authorities were investigating the accident.
