OAKLAND, Calif. —

Authorities say an armed robbery suspect who was shot in the back by an Oakland police officer has been charged with four felonies.

Alameda County prosecutors on Wednesday charged 24-year-old Tony Jones of Oakland with second-degree armed robbery and three weapons violations including possession of a firearm by a felon.

Jones' lawyer, Waukeen McCoy, says Jones was unarmed and he intends to sue the city. McCoy says Jones is a cousin of Oscar Grant, an unarmed man who was shot and killed by Bay Area Rapid Transit police officer Johannes Mehserle on New Year's Day 2009.

Police say Jones was shot late Sunday after officers stopped him and another passenger inside a van suspected of being used in a robbery.

Jones was wounded after running from the van allegedly armed with a gun. He is hospitalized in stable condition.
