The 6-year-old son of a woman killed when her boyfriend crashed his car into a tree on a Berkeley street last week has died of his injuries, authorities said.
The Alameda County Sheriff’s Office Coroner’s Bureau said Xavier Chevez died of his injuries last Friday at Oakland’s Children’s Hospital. He had been on life support since the early morning hours of May 18 when his mother – UC Berkeley student Milanca Lopez -- was killed in an accident at California Street and Allston Way.
Jose Lumbreras, 33, was driving the car at a high rate of speed at the time it careened into the tree. Blood tests have determined his blood-alcohol level was 0.219 – nearly three times the legal limit of 0.08 percent, authorities said.
The Alameda County district attorney’s office has already charged Lumbreras with gross vehicular manslaughter while intoxicated in Lopez’s death. He could now be facing a second count following Chevez’s death.
