The ethics probe for suspended San Francisco Sheriff Ross Mirkarimi was expected resume at San Francisco City Hall early Wednesday evening with the anticipated testimony of his wife Eliana Lopez taking center stage.
Lopez returned from Venezulea earlier that week to testify about her marriage to Mirkarimi, coming back to the Bay Area for the first time since leaving about three months ago.
Her attorney Paula Canny told KTVU her client returned from her native country without her and Mirkarimi's young son Theo.
Canny said she met with Lopez late Tuesday afternoon to prepare for the hearing.
"The commission is going to see that she's not afraid of Ross," said Canny. "She loves Ross. She feels somewhat invaded by this entire process. She's committed to her family, committed to Ross and her son."
Canny told KTVU Lopez will put the emotional video made by neighbor Ivory Madison of Lopez displaying a bruise on her arm caused by Mirkarimi into context.
The attorney said Madison caused Lopez to fear losing custody of her son because Lopez is not an American citizen.
"She got completely freaked out by what Ms. Madison said to her regarding custody of Theo," said Canny.
Former San Francisco prosecutor Jim Hammer said on Tuesday that Mirkarimi's defense team was taking a risk.
"It's a long shot. It's a Hail Mary pass," said Hammer. "It's a last chance from him to change what people think about this case."
Hammer explained that any time the defense puts a witness on the stand, it is hard to predict what that person will say on cross examination.
"I've never seen a case so solidly a legal proceeding, but also a political proceeding," said Hammer.
Canny told KTVU she's asked for a translator in case there were nuances that may be confusing to Lopez, but that her testimony would be given in English.
She described Lopez as quote "resolute" and looking forward to telling the truth.
