A former Santa Clara County Correctional Deputy has been arrested for the assault of an inmate at San Jose’s main jail in 2013. The Santa Clara County Sheriff’s Office confirmed the arrest on Monday.

The Sheriff’s Office says Timmy Tri, 35, assaulted an inmate in October 2013, using his feet, striking the inmate in the head and face.

Tri was said to have been put on administrative leave at that time while the case was submitted to the Santa Clara County District Attorney’s Office. No charges were filed at that time, but in March 2016, The Sheriff’s Office resubmitted the case against Tri and issued an arrest warrant.

Tri was arrested Monday in San Jose by the Santa Clara Sheriff’s Department and is charged with assault with a deadly weapon under color of authority. According to the sheriff’s department, Tri was last paid by the county in August of 2015.
