San Jose OKs temporary ban on recreational marijuana

SAN JOSE (KTVU) -- The San Jose City Council on Tuesday approved an emergency measure to ban the recreational use of marijuana one week before California voters head to the polls to consider legalizing the drug.

The 10-1 vote by the San Jose council was an attempt to put some controls in place while city officials figure out how to comply with the legal recreational use of marijuana -- if a majority of voters approve it on Nov. 8.

The city is trying to figure out how it can restrict the growth of marijuana for commercial purposes if Proposition 64 passes. The measure would allow residents 21 and older to smoke, process and transport weed. Residents would be allowed to grow up to 6 plants indoors but municipalities can still decide how commercial uses will be implemented within their city limits.

San Jose city officials said they want to impose some controls to stem the number of dispensaries that could open and cater to recreational marijuana users.
